Terms and Conditions (AGB)

1. Scope of Application

These Terms and Conditions apply to all orders placed by consumers within the meaning of the Austrian Consumer Protection Act (KSchG) via the online shop www.kleiderhaufen.com.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
By submitting your order, you make a binding offer to enter into a purchase agreement.
The order confirmation sent automatically by email does not yet constitute acceptance of the offer.
The contract is only concluded once a separate shipping confirmation has been sent or the goods have been delivered.

4. Prices and Shipping Costs

All prices are final prices in accordance with the Austrian small business regulation (§ 6 para. 1 no. 27 UStG) and do not include VAT.
Any shipping costs incurred are shown separately during the ordering process.

5. Delivery

We deliver within Austria and, if applicable, to other EU countries.
Unless otherwise stated on the product page, delivery time is typically 3–7 working days.

6. Payment Methods

The following payment methods are available:

  • PayPal

  • Sofort (instant transfer)

  • Bank transfer (prepayment)

7. Right of Withdrawal (Right to Cancel)

Consumers have the right to cancel this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you or a third party named by you (other than the carrier) received the goods.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Warranty and Liability

The statutory warranty provisions under Austrian civil law (ABGB) and consumer protection law (KSchG) apply.
We are only liable for damages caused intentionally or by gross negligence.
This does not apply to personal injury, for which we are also liable in cases of slight negligence.

10. Applicable Law and Jurisdiction

Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
For consumers, the place of jurisdiction is determined by their place of residence in accordance with legal regulations.

11. Severability Clause

If ny provision of these Terms and Conditions is or becomes invalid, this shall not affect the validity of the remaining provisions.
